General Terms and Conditions of Seasonal Rentals – Cotoon Gestion

1 – Purpose of the contract

These General Terms and Conditions are concluded between:

  • COTOON GESTION SASU, trading as Cotoon, registered office at 4 rue Basque, 68000 Colmar, France, registered with the RCS of Colmar under number B 898 213 301, SIRET 898 213 301 00010, APE code 6831Z, holder of the professional real estate management license no. CPI 6801 2022 000 000 008 issued by the CCI Alsace Eurométropole (valid until 05/12/2025), with a financial guarantee from GALIAN Assurance (89 rue de la Boétie, 75008 Paris).

  • The guest, who has booked accommodation via www.cotoon.com or through a third-party booking platform.

The rental agreement includes the price, charges and special conditions indicated in the booking confirmation.


2 – Legal framework

This seasonal rental is reserved for tourist use only (Articles L324-1 to L324-2-1 of the French Tourism Code and Articles 1709 et seq. of the Civil Code).
It is not subject to residential lease law and does not grant any right to remain in the premises after the end of the stay.


3 – Property description

The accommodation is rented fully furnished, in perfect condition, and must be used responsibly by the guest.


4 – Assignment and subletting

This contract is strictly personal to the named guest.
Subletting, transfer, or lending the accommodation is strictly prohibited.


5 – Duration of stay

The stay duration is fixed at booking.
The guest has no right to remain in the premises beyond the departure date.


6 – Booking confirmation and terms

The contract is deemed concluded upon provision of personal and/or payment details and payment of the rental or deposit, according to the chosen tariff conditions.

  • Bookings via www.cotoon.com:

    • Payment of the rental and security deposit through Swikly (secured by bank imprint).

    • Depending on the cancellation policy chosen, payment is due 1 month, 15 days, or 7 days before arrival.

    • Bookings with the code “COTOON10”: full payment at booking, non-cancellable and non-refundable.

  • Bookings via third-party platforms (Airbnb, Booking, etc.):

    • Payment through the platform.

    • Security deposit exclusively via Swikly.

No booking is considered final without written confirmation from Cotoon Gestion.


7 – Payment methods

  • Online via Swikly (rental + deposit for direct bookings).

  • By cheque (advance bookings, to be received within 48h).

  • By bank transfer (at least 30 days before arrival).

⚠️ No keys will be handed over without full payment of the rental and deposit.


8 – Cancellation and modification by the guest

  • Cancellation before arrival: the deposit remains due to Cotoon Gestion.

  • Modification:

    • If the new booking is cheaper → no refund.

    • If more expensive → guest must pay the difference.

  • No-show: contract void after 24h, deposit remains due, and the balance will be claimed.


9 – Cancellation or modification by Cotoon Gestion

If Cotoon Gestion cancels or modifies a key element before the stay, the guest will be informed and offered either:

  • alternative accommodation, or

  • a full refund of amounts paid.


10 – Check-in / Check-out

  • Check-in: from 4:00 PM.

  • Check-out: by 10:00 AM at the latest.
    Late departure without written agreement will be charged as an extra night.


11 – Balance of payment

The balance of the rental is charged 1 month before arrival.


12 – End-of-stay cleaning

Standard cleaning is included (linen change, general cleaning of rooms and bathrooms).
The guest must:

  • empty trash bins,

  • wash and store dishes,

  • empty fridge, freezer, dishwasher, ovens, microwave.

Failure to do so will result in an extra cleaning fee (minimum €60) deducted from the deposit.
Optional “full cleaning” service may be booked before arrival.


13 – Inventory and condition report

An inventory and condition report are provided upon check-in.
The guest has 72 hours to contest. After this period, the documents are deemed accepted.


14 – Security deposit

Collected via Swikly (bank imprint or payment).
Covers:

  • damage, breakage, lost keys,

  • extra charges or services,

  • violation of house rules (noise, smoking, pets where prohibited, etc.).

Refunded within 14 days after departure, less any justified deductions.


15 – Use of premises

The guest agrees to:

  • use the accommodation responsibly,

  • respect the maximum capacity stated in the listing and booking confirmation,

  • not organize parties or cause noise disturbances,

  • comply with building regulations,

  • not smoke inside (penalty min. €300),

  • cover costs for lost keys/badges,

  • ensure children’s safety (windows, stairs),

  • not contact the property owner directly.

Pets:

  • Allowed only in properties marked “pets allowed”, with a surcharge (€30/stay/pet).

  • Strictly prohibited in other properties (penalty min. €300 if violated).


16 – Insurance

The guest must hold holiday rental insurance (villégiature) covering their liability.
Cotoon offers optional complementary insurance through Meetch Cover.


17 – Data protection

Personal data provided is used solely to process the booking.

18 – Disputes

In the event of a dispute, the guest may refer the matter to a consumer mediator (Article L612-1 of the French Consumer Code).
If no amicable solution is found, the competent courts will be seized according to applicable law.


19 – Financial guarantee

Cotoon Gestion SASU benefits from a financial guarantee issued by GALIAN Assurance, 89 rue de la Boétie, 75008 Paris.


20 – Professional liability insurance

Cotoon Gestion SASU is covered by GALIAN Assurance (89 rue de la Boétie, 75008 Paris).
